From the introduction: “After World War II and the unification of the Services in 1947, the US military’s long-standing proscription against homosexuals in uniform became increasingly difficult to sustain. Chief among the challenges to the prohibition was the establishment of the Uniform Code of Military Justice and the United States Court of Military Appeals, which involved instituting reforms that expanded servicemembers’ legal rights. Likewise, the US Supreme Court’s 1953 decision that court-martial proceedings were subject to the requirements of constitutional due process and its 1957 ruling that agency administrative decisions were subject to judicial scrutiny also increased legal protections for servicemembers and veterans.”
